The Leak From The Right
A thought occurred to me this week, but no one I talked to bought in to it until late yesterday…so here’s a new thought on the leak of that Supreme Court draft opinion.
Maybe it was orchestrated by someone on the right side of the political spectrum.
It appears that there are five justices in favor of overruling Roe v. Wade. That’s the February draft opinion we all saw. Chief Justice John Roberts is not one of them.
I believe Roberts would have supported limits on Roe, but not overruling it. What if the Chief has been doing some arm twisting, trying to get one of the current majority to join him in a more moderate position? What if one of the five started getting cold feet on such a precedential break? Is it possible that someone–perhaps aligned with the Alito or Thomas camps–leaked the ruling to help keep the original group together? Any of the original five who changes his or her mind before the final ruling would therefore be seen as a waffler.
There’s another school of thought that says the group of five is solid, but someone on the right leaked the ruling so that the left can get all the protesting, etc., out of its system and the decision is a faded memory by the November general election. Hard to stay that mad and turn the anger into voting action that long. A June release of the ruling, as scheduled, makes it six weeks closer to the election.
Those who don’t like this possible ruling stay focused on what it says, but until it’s official it’s nothing more than a solid rumor. The back story, as I’ve said before, may have longer-lasting ramifications than even overturning Roe.
