Breyer, Retire

That is apparently the chant among some on the left who are publicly pushing for U.S. Supreme Court Justice Stephen Breyer to step down so that President Biden can name a replacement while Democrats have working control of the U.S. Senate.

Politico notes that Justice Breyer gave a speech this week criticizing calls to increase the size of the Court, the so-called Court packing…and that has led so-called reformers to more loudly call for Breyer to get out of the way so Biden can make good on his promise to nominate the first black woman to the court.

There’s a petition drive, and a mobile billboard truck making its way through the nation’s capitol starting today, carrying the message to the court building and the capitol.

They note that it was 11 years ago today that Justice John Paul Stevens retired so President Obama could name Elena Kagan to the court. Politico does note that Stevens was 90 years of age at the time…Breyer is by comparison a young 82.

The activists fear that the Senate may go back into Republican hands after the 2022 election and their opportunity will be lost. But telling a Supreme Court justice when to leave is tricky, as it’s just as likely to lead Breyer or anyone else in that spot to stay even longer than they might otherwise have.

One activist said, “this can’t wait much longer”…which tells you a lot about the attitude of those on the far left.
